DATA PROTECTION DECLARATION & LEGAL NOTICE

 

Introduction

The Smart Networks and Services Joint Undertaking (the “SNS JU”), set up by Council Regulation (EU) 2021/2085 of 19 November 2021, is committed to user privacy.

The SNS JU processes personal data in compliance with Regulation (EU) 2018/1725 of the European Parliament and Council of 23 October 2018 on the protection of natural persons with regard to the processing of personal data by the Union institutions, bodies, offices and agencies and on the free movement of such data, and repealing Regulation (EC) No 45/2001 and Decision No 1247/2002/EC.

This Data Protection Declaration & Legal Notice describes the personal data that are processed by the SNS JU, why and how, and the rights that data subjects have in relation to their personal data. We recommend that anyone who accesses our website read this notice in full to ensure that she/he is fully informed.

The browsing of this website is possible without providing any personal data.

In some cases where a user/data subject would like to use services via the SNS JU website, personal information may be required and processed to provide the requested services. Those services may include:

  • Use of the website
  • Any communication with the SNS JU
  • Registration for and participation in our events
  • Subscription to our newsletter

In other cases, this website provides links to third party sites, which are not under the SNS JU’s control. When leaving the SNS JU website, we recommend that the user/data subject consults the privacy policies of the third parties as they are responsible for the processing of personal data and they may require to accept their specific terms and conditions.


 1. Definitions

In this Data Protection Declaration, the following terms are based on the Regulation (EU) 2018/1725:

  • A) Personal Data

Personal data means any information relating to an identified or identifiable natural person (“data subject”). An identifiable natural person is someone who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

  • B) Data Subject

Data subject is any identified or identifiable natural person, whose personal data is processed by the controller responsible for the processing.

  • C) Processing

Processing is any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

  • D) Restriction Of Processing

Restriction of processing is the marking of stored personal data with the aim of limiting their processing in the future.

  • E) Profiling

Profiling means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular, to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

  • F) Pseudonymisation

Pseudonymisation is the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

  • G) Controller Or Controller Responsible For The Processing

Controller or controller responsible for the processing is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

  • H) Processor

Processor is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

  • I) Recipient

Recipient is any natural or legal person, public authority, agency or another body, to which personal data are disclosed, whether a third party or not. However, public authorities which may receive personal data in the context of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients; the processing of these data by the public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing.

  • J) Third Party

Third party is a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

  • K) Consent

Consent of the data subject is any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by clear affirmative action, signifies agreement to the processing of personal data relating to him or her.


  2. General and technical data collected and processed by the SNS JU when visiting our website and why

The website of the SNS JU collects a series of general data and information when a data subject or automated system calls up the website.

These general data and information are stored in the server log files.

Data collected may be (a) the browser types and versions used, (b) the operating system used by the accessing system, (c) the website from which an accessing system reaches our website (so-called referrers), (d) the sub-websites, (e) the date and time of access to the Internet site, (6) an Internet protocol address (IP address), (f) the Internet service provider of the accessing system, (g) device identifier, and (h) any other similar data and information that may be used in the event of attacks on our information technology systems.

When using these general data and information, the SNS JU does not draw any conclusions about the data subject. Rather, this information is needed to (a) deliver the content of our website correctly, (b) optimize the content of our website, (c) ensure the long-term viability of our information technology systems and website technology, and (d) provide law enforcement authorities with the information necessary for criminal prosecution in case of a cyber-attack.

Therefore, SNS JU analyses anonymously collected data and information statistically, with the aim of increasing the data protection and data security of its website, and to ensure an optimal level of protection for the personal data that it processes.

The anonymous data of the server log files are stored separately from all personal data provided by a data subject.

Some information may be collected through cookies, as explained in the section on cookies.


   3. Personal data collected and processed by the sns ju when using our website or engaging with us and why

  • A) When you useour website, the SNS JU processes:

    • The General and Technical information regarding your visit;
    • Any other personal data you provide the SNS JU with on a voluntarily basis. However, we ask you not to provide us with any personal data from third parties without obtaining their valid consent.
  • B) Communication or contact with the SNS JU

The website of SNS JU contains information that enables direct contacts or communications with the SNS JU.

When data subjects communicate with the SNS JU via e-mail, telephone, letter, social media or any other means, the SNS JU may process the following personal data:

  • Identity information, such as first name and last name;
  • Contact details, such as e-mail address, postal address, country and (mobile) telephone number;
  • Content of the communication, such as question, idea or complaint;
  • Technical information of the communication, such as with whom you communicate at our end, and date and time of the communication;
  • Any other personal data you provide us with.

If a data subject contacts the SNS JU by e-mail or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the SNS JU are stored for the purpose of processing or contacting the data subject, responding to his/her inquiry, question or idea or managing his/her complaint. There is no transfer of this personal data to third parties.

The SNS JU website may also list open vacancies and open procurement procedure. You can visit these sections without providing personal information. Any contact and communication with the SNS JU and any personal information provided to the SNS JU in these contexts will be processed by the SNS JU for the purpose of responding to your request.

  • C) Registration on our website and participation in our events

Users can register on our website for and to participate in our events. The input mask used for this purpose determines what personal data are transmitted to the SNS JU.

In this context, the SNS JU may process the following personal data:

  • Identity information, such as first name and last name, gender, title, organisation, job responsibilities;
  • Contact details, such as e-mail address, postal address, country and (mobile) telephone number;
  • Business card details, if you provide us with your business card before, during or after the event;
  • Interests in certain topics;
  • Any other personal data you provide us with.

The personal data entered by the data subjects are collected and stored exclusively for internal use by the SNS JU, and for his own purposes.

By registering on the website of the controller, the IP address—assigned by the Internet service provider (ISP) and used by the data subject—date, and time of the registration are also stored. The storage of this data takes place against the background that this is the only way to prevent the misuse of our services, and, if necessary, to make it possible to investigate committed offenses.

The registration of the data subject, with the voluntary indication of personal data, is intended to enable the SNS JU to offer the data subject contents or services that may only be offered to registered users due to the nature of the matter in question. Registered persons are free to change the personal data specified during the registration at any time, or to have them completely deleted from the data stock of the SNS JU.

Photos can also be taken during our events. In principle, only photos will be taken of the crowd. However, if you pose for our photographer, the SNS JU will derive your permission from this. Your photo can then be distributed via our website or other channels for the promotion of the Joint Undertaking and the event in question. If you do not wish to do so, please contact our Data Protection Officer via email.

  • D) Subscription to our Newsletters and Newsletters-Tracking

On the website of the SNS JU, users are given the opportunity to subscribe to our newsletter. The input mask used for this purpose determines what personal data are transmitted to the SNS JU, as well as when the newsletter is ordered from the SNS JU.

In this context, the SNS JU may process the following personal data:

  • Identity information, such as first name and last name, gender, title, organisation, job responsibilities;
  • Contact details, such as e-mail address, postal address, country and (mobile) telephone number;
  • Interests in certain topics;
  • Frequency for receiving newsletters.

The newsletter may only be received by the data subject if the data subject has a valid e-mail address. A confirmation e-mail will be sent to the e-mail address registered by a data subject for the first time for newsletter sending, for legal reasons, in the double opt-in procedure. This confirmation e-mail is used to prove whether the owner of the e-mail address as the data subject is authorized to receive the newsletter.

During the registration for the newsletter, we also store the IP address of the computer system assigned by the Internet service provider (ISP) and used by the data subject at the time of the registration, as well as the date and time of the registration. The collection of this data is necessary in order to understand the (possible) misuse of the e-mail address of a data subject at a later date, and it therefore serves the aim of the legal protection of the controller.

The personal data collected as part of a registration for the newsletter will only be used to send our newsletter. In addition, subscribers to the newsletter may be informed by e-mail, as long as this is necessary for the operation of the newsletter service or a registration in question, as this could be the case in the event of modifications to the newsletter offer, or in the event of a change in technical circumstances. There will be no transfer of personal data collected by the newsletter service to third parties. The subscription to our newsletter may be terminated by the data subject at any time. The consent to the storage of personal data, which the data subject has given for sending the newsletter, may be revoked at any time. For the purpose of revocation of consent, a corresponding link is found in each newsletter. It is also possible to unsubscribe from the newsletter at any time directly on the website of the controller, or to communicate this to the controller in a different way.

The Newsletters of SNS JU contains so-called tracking pixels. A tracking pixel is a miniature graphic embedded in such e-mails, which are sent in HTML format to enable log file recording and analysis. This allows a statistical analysis of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, the SNS JU may see if and when an e-mail was opened by a data subject, and which links in the e-mail were called up by data subjects.

Such personal data collected in the tracking pixels contained in the newsletters are stored and analysed by the SNS JU in order to optimize the sending of the newsletter, as well as to adapt the content of future newsletters even better to the interests of the data subject. These personal data will not be passed on to third parties. Data subjects are at any time entitled to revoke the respective separate declaration of consent issued by means of the double-opt-in procedure. After a revocation, these personal data will be deleted by the SNS JU. The SNS JU automatically regards a withdrawal from the receipt of the newsletter as a revocation.


      4. Legal basis for the processing of personal data

The legal basis for collecting and processing personal data will depend on the personal data concerned and the specific context in which the SNS JU collects it.

The SNS JU will by default collect and process personal data only where it has obtained the consent of the data subjects or where it needs such data to perform a contract to which the data subjects are party. The SNS JU may also collect and process personal data where the processing is in the legitimate interest of the SNS JU (e.g. compliance to a legal obligation to share personal data with competent law enforcement agents or representatives, judicial authorities, governmental agencies or bodies) or on the basis of its tasks carried out in the public interest (e.g. the performance of dissemination activities).


    5. Data location

The SNS JU processes personal data within the European Economic Area (EEA).


    6. Subcontractors

The SNS JU may share data subjects’ personal data with its third parties service providers. These third parties are only allowed to process data subjects’ personal data on the SNS JU behalf, upon SNS JU instructions and they must guarantee the data protection and confidentiality required by Regulation (EU) 2018/1725.

The SNS JU may use the services of third party service providers, as data processor, for the design of the website, the management of the newsletters and the registration to events, the storage of personal data and the management of IT infrastructure, files and backups.


    7. Data Security

The SNS JU will take appropriate technical and organizational measures to keep the personal data of data subjects safe from unauthorized access or theft as well as accidental loss tampering or destruction. Access by our personnel or third parties’ personnel will only be on a need-to-know basis and be subject to strict confidentiality obligations. Also, access may be required by the rules and regulations to the European Commission. You understand, however, that safety and security are best efforts obligations which can never be guaranteed.


    8. Data Retention

The SNS JU processes and stores the personal data of the data subjects only for the period necessary to achieve the purposes outlined in this Data Protection Declaration, or as far as this is permitted by the applicable data protection laws.

If the data is no longer needed for the purposes described in this Data Protection Declaration or if the maximum legal retention period expires, the personal data are routinely blocked or erased. However, the SNS JU cannot delete the personal data if there is a legal or regulatory obligation or a court or administrative order preventing it from doing so.


    9. Rights Of The Data Subjects

Data subjects have rights related to the processing of their personal data and can contact the SNS JU at any time via email to exercise them.

Those rights include:

  • The Right of Information and Access to all their personal data processed by the SNS JU. Data subjects can request a copy of their personal data, which the SNS JU will provide in a commonly used electronic form. The SNS JU may require the data subjects to provide his/her identity before providing the requested information.
  • The Right to Rectification. Data subjects can require that their personal data are amended or corrected if they are incomplete or inaccurate.
  • The Right to Erasure (Right to be forgotten). Data subjects can request the deletion of their personal data if the data are no longer necessary in relation to the purposes for which they were collected or otherwise processed, as outlined in this Data Protection Declaration, or if the Data Subjects have withdrawn their consent. The data will be deleted unless the SNS JU is required to retain such data in order to comply with a legal obligation or to establish, exercise or defend legal claims.
  • The Right to Restriction. Data subjects can request that the SNS JU limits the processing of their personal data where the data subjects contest the accuracy of the personal data, or where the processing is unlawful, or where the SNS JU does no longer need to process the data for a particular purpose but is not able delete the data due to a legal or other obligation or because the data subjects do not want the SNS JU to delete their data.
  • The Right to Data Portability. If the data are processed based on consent or a contract with the SNS JU and the processing is carried out by automated means, data subjects can request to receive in a structured, commonly-used and machine-readable format all personal data they have provided to SNS JU or, where technically possible, that their personal data are transmitted to another data controller.
  • The Right to Object. Where the legal justification of the data processing is the SNS JU’s legitimate interest, data subjects have the right to object to the processing of their personal data on grounds relating to their particular situation. The SNS JU will be obliged to respond to these requests unless it has compelling legitimate grounds for the processing which override the data subjects’ interests, rights and freedoms, or if it needs to continue to process the data for the establishment, exercise or defence of a legal claim.
  • The Right to Withdraw the Consent previously given to process their personal data.

The SNS JU reserves the right to restrict some of the above data subjects’ rights in duly justified cases (e.g. internal audits, processing of complaints, investigations carried out by the Data Protection Officer or security investigations).

If data subjects consider that their rights are infringed or that the SNS JU has not complied with the applicable data protection laws, they have the right to lodge a complaint with the European Data Protection Supervisor.

The SNS JU reserves the right to modify or update this Data Protection Declaration & Legal Notice from time to time in response to legal, technical or business developments. If the changes affect the personal data collected, the SNS JU will take appropriate measures to inform data subjects, which will be consistent with the significance of the changes made (e.g. by email or by posting on the website).

    12. Automated Individual Decision-Making, Including Profiling

The SNS JU does not use automated decision-making or profiling.


    13. Europa Cookies (With Anonymization Function)

What is a cookie? 

Cookies are text files that are stored in a computer system via an Internet browser. The Internet pages of SNS JU use cookies.  Many Internet sites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a character string through which Internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This allows visited Internet sites and servers to differentiate the individual browser of the data subject from other Internet browsers which contain other cookies. A specific Internet browser can be recognized and identified using the unique cookie ID. Through the use of cookies, the SNS JU can provide the users of this website with more user-friendly services that would not be possible without the cookie setting.

By means of a cookie, the information and offers on our website can be optimized with the user in mind. Cookies allow us, as previously mentioned, to recognize our website users. The purpose of this recognition is to make it easier for users to utilize our website. The website user who uses cookies, e.g., does not have to enter access data each time the website is accessed, because this is taken over by the website, and the cookie is thus stored on the user’s computer system. To improve the accuracy of the reports, certain information is also stored in first-party cookies and then collected by Europa Analytics:

  • random unique visitor ID
  • time of the first visit by the specific visitor
  • time of the previous visit by the specific visitor
  • number of visits by the specific visitor

The European Commission retains full responsibility and control of the data collected through first-party cookies by storing the data in servers fully controlled by the European Commission.

The data collected contains no personal information and the random unique visitor ID that is generated by the software cannot be used to identify a particular visitor. Data will not be shared with any other organisations for marketing, market research or commercial purposes.

More about Europa Analytics

Europa Analytics is based on the open-source analytics platform Matomo and is installed on a PHP/MySQL webserver. Both the infrastructure and software are under the full control of the European Commission and comply with the current EU data protection legislation. Europa Analytics’ privacy protection has been validated by the Data Protection Officer of the European Commission Europa Analytics is maintained by the Commission’s Directorate-General for Informatics and is provided as a service to website owners across the European Commission to ensure that our online communication is targeted, relevant and cost-efficient.

The service is present on Commission owned websites and pages under the europa.eu domain and its subdomains, but is implemented mainly on the main Commission subdomain ec.europa.eu. The European Commission manages the inter-institutional website (top-level pages of the europa.eu domain) on behalf of all the EU institutions.     14. Matomo Analytics

Matomo Analytics for WordPress

For statistical purposes, the Smart Networks and Services Joint-Undertaking (SNS JU) uses “Matomo” (formerly “Piwik”) on this website. Matomo is an open source web analysis tool. Matomo does not transfer any data to servers outside the control of the SNS JU.

Matomo uses so-called “cookies”. Cookies are text files that are saved on your computer and enable the SNS JU Office to analyse how its website is used. The information provided by the cookie is transferred to the SNS JU Office server and saved there, to enable us to analyse user behaviour. Your IP address will be immediately anonymised; users are thus anonymous. The information generated by the cookie regarding how you use the website will not be passed on to third parties.

The SNS JU Office sees this analysis as an integral part of its online service. This information helps to consistently improve the website and optimise it according to user needs.

The SNS JU website provides link to third party sites. The SNS JU does not control those websites and is not responsible for their processing of personal data.

Since each social media channel has its own policy on the way they process personal data when you access their websites, we encourage the users to review their individual privacy policies. For example, if you choose to watch one of our videos on YouTube, you will be asked for explicit consent to accept YouTube cookies; if you look at our Twitter activity on Twitter, you will be asked for explicit consent to accept Twitter cookies; the same applies for LinkedIn.

  • A) Application And Use Of LinkedIn

The SNS JU has integrated components of the LinkedIn Corporation on this website. LinkedIn is a web-based social network that enables users with existing business contacts to connect and to make new business contacts. Over 400 million registered people in more than 200 countries use LinkedIn. Thus, LinkedIn is currently the largest platform for business contacts and one of the most visited websites in the world.

The operating project of LinkedIn is LinkedIn Corporation, 2029 Stierlin Court Mountain View, CA 94043, UNITED STATES. For privacy matters outside of the UNITED STATES LinkedIn Ireland, Privacy Policy Issues, Wilton Plaza, Wilton Place, Dublin 2, Ireland, is responsible.

With each call-up to one of the individual pages of this Internet site, which is operated by the SNS JU and on which a LinkedIn component (LinkedIn plug-in) was integrated, the Internet browser on the information technology system of the data subject is automatically prompted to the download of a display of the corresponding LinkedIn component of LinkedIn. Further information about the LinkedIn plug-in may be accessed under https://developer.linkedin.com/plugins. During the course of this technical procedure, LinkedIn gains knowledge of what specific sub-page of our website was visited by the data subject.

If the data subject is logged in at the same time on LinkedIn, LinkedIn detects with every call-up to our website by the data subject—and for the entire duration of their stay on our Internet site—which specific sub-page of our Internet page was visited by the data subject. This information is collected through the LinkedIn component and associated with the respective LinkedIn account of the data subject. If the data subject clicks on one of the LinkedIn buttons integrated on our website, then LinkedIn assigns this information to the personal LinkedIn user account of the data subject and stores the personal data.

LinkedIn receives information via the LinkedIn component that the data subject has visited our website, provided that the data subject is logged in at LinkedIn at the time of the call-up to our website. This occurs regardless of whether the person clicks on the LinkedIn button or not. If such a transmission of information to LinkedIn is not desirable for the data subject, then he or she may prevent this by logging off from their LinkedIn account before a call-up to our website is made.

LinkedIn provides under https://www.linkedin.com/psettings/guest-controls the possibility to unsubscribe from e-mail messages, SMS messages and targeted ads, as well as the ability to manage ad settings. LinkedIn also uses affiliates such as Eire, Google Analytics, BlueKai, DoubleClick, Nielsen, Comscore, Eloqua, and Lotame.   • B) Application And Use Of Twitter

On this website, the SNS JU has integrated components of Twitter. Twitter is a multilingual, publicly-accessible microblogging service on which users may publish and spread so-called ‘tweets,’ e.g. short messages, which are limited to 140 characters. These short messages are available for everyone, including those who are not logged on to Twitter. The tweets are also displayed to so-called followers of the respective user.
